RESOLVED UNANIMOUSLY
That the application to amend conditions of consent use approval in respect of Erf 61958, Cape Town BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 subject to the conditions contained in the attached Addendum B.
CONDITIONS AMENDED
1.1. Condition 2.3
Not more than 34 80 children in connection with the ECD centre shall be on the property at any one time.
2.2. Condition 2.4
That the day-care hereby permitted shall only operate between 7:00am – 06:00pm from Mondays to Fridays
3.2 The owner shall be responsible for the payment of development contributions towards the provision of bulk civil engineering services in accordance with Council’s policies
Condition 2.5 is deleted
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out as below
1. The City’s Transport Planning department has already supported 80 children on the property in terms of traffic related concerns raised by the objectors.
2. Permitting an increased number of children at the existing early childhood development centre will increase opportunities for parents, children and workers to benefit from this essential community service.
3. The location of the property (to accommodate 80 children) is desirable due to its proximity to commercial and residential land uses, public amenities and public transport corridors, modes and interchanges (namely Lansdowne Road which is an activity street).
4. Traffic and parking impacts have been satisfactorily mitigated by the applicant and are supported by the City’s Transport Planning department, especially as it relates to impacts on the surrounding owners.
5. The City Health department has assessed the proposal and has determined that the property can accommodate 80 children,
6. The change to the number of staff is integral to the increase of the number of children.
7. The proposal is consistent with the assessment criteria for large-scale early childhood development centres as contemplated in the City’s Early Childhood Development Land Use Policy and is deemed to be desirable in terms of section 99(3) of the Municipal Planning By-law, 2015.
