Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for subdivision of Remainder Erf 96811 Cape Town at Rondebosch, BE APPROVED in terms of 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/00/96811, subject to the conditions contained in Annexure A.

b. The application for departures, as set out in Annexure A, for Remainder Erf 96811 Cape Town at Rondebosch, BE APPROVED in terms of 98(b) of the Municipal Planning By-Law, 2015.

c. The application for Council’s approval in terms of Item 162(1) of the Development Management Scheme to permit building work, demolition, subdivision and the felling of trees within a Heritage Protection Overlay Zone, as set out in Annexure A, on Remainder Erf 96811 Cape Town at Rondebosch, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

APPLICATION 1.2 IS AMENDED AS FOLLOWS:

1.2 Item 162: For Council’s approval to permit building work, demolition, subdivision and the felling of trees within a Heritage Protection Overlay Zone as per the plans drawn by MLH Architects and Planners, with drawing numbers SK 00, SK 01, SK 02, SK 03 and SK 04, all Revision 8, and all dated 19/09/2019.


REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report, except reason 7.1.2 and 7.1.3 which are amended as follows”

7.1.2 The proposal is compatible with the surrounding land uses and will not materially change the character of the area and will not have a significant negative impact on neighbouring properties.
7.1.3 The resultant urban form and architecture will fit in well with that in the area.
