RESOLVED UNANIMOUSLY:

That an administrative penalty in the amount of R10 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 18292, Parow in accordance with plan attached as Annexure B.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons as set out below

6.1 The owner has knowingly provided incorrect information to Council with regard to the date of the unauthorised building work. In terms of Section 78 of the bylaw this is a serious contravention
6.2 The extent of the contravention is large
6.3 The duration is long as confirmed by aerial photographs
6.4 The gravity is serious
