RESOLVED UNANIMOUSLY that

a. The application for the rezoning of Erf 7650, Bellville, Oakdale from Single Residential 1 (SR1) to Local Business 2 (LB2) to permit offices BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.

b. The application for consent use in respect of Erf 7650, Bellville, Oakdale to allow for a conference facility BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.

c. The application for permanent departure in respect of Erf 7650, Bellville, Oakdale involving the relaxation of the 3m common boundary building lines to 1.2m, 1.1m and 0.0m respectively BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.

d. The application for permanent departure in respect of Erf 7650, Bellville, Oakdale involving the relaxation of on-site parking requirements from 17 bays to 4 bays BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.

REASONS FOR DECISION:

The MPT REFUSED the application for the reasons as set out in Planner’s report, except reason 7.1.1 which is amended as follows:

7.1.1 The proposal reflects inaccurate information on the exact scale of the proposed use. The actual GLA clearly reflects an even greater lack of on-site parking than what is indicated in the application.
