UNANIMOUSLY RESOLVED that:
a. The application for rezoning from a General Business, Sub-zone GB7 to a Mixed Use, Sub-Zone MU3 as set out in Annexure A, of Erf 177650, 1 Rose Street, Cape Town BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to conditions contained in Annexure A.
b. The application for Council’s approval as set out in Annexure A, of Erf 177650, 1 Rose Street, Cape Town BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to conditions contained in Annexure A
c. The application for departures from the floor factor as set out in Annexure A, of Erf 177650, 1 Rose Street, Cape Town BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to conditions contained in Annexure A
d. The application for Departure from the carriage-way-crossing width, as set out in Annexure A on Erf 177650 Cape Town, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report
Amend Annexure A:
5.1 Notwithstanding uses permitted in the referred to MU3 zone, Industry related uses shall be limited to Warehousing only.
Delete condition 5.2 and update numbering sequence accordingly
Renumber old 5.3 to be 5.2 and amend as follows:
The ground, 1st and 2nd floors on Rose Street and Waterkant Street shall contain restaurants, shops and offices (active uses), to the satisfaction of the authorized official
Add new 5.3:
A revised site development plan shall be submitted to the satisfaction of the authorized official
Amend condition 5.4 as follows:
The owner shall pay a development charge (DC) in accordance with the Development Charges Policy for Engineering Services for the City of Cape Town. The total amount payable shall be calculated in accordance with the revised Site Development Plan to be submitted. It must be noted that this amount is calculated for the period up until 30 June 2020 and that the amount due will be escalated annually with the Construction Price Adjustment Formula (CPAF) using the industry indices of StatsSA. The DC’s shall be paid prior to approval of building plans.
