UNANIMOUSLY RESOLVED that:
a. The application in terms of 42(b) for the relaxation of the 5m street building line (along Drommedaris Road) applicable to garages to 4.82m (double garage) and 4.82m (single garage) respectively to allow for the proposed garages on erf 3375, Somerset West BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with Building Plan No. 04524/maree/ssw3375/rev01 – Dated May 2019 and subject to conditions in Annexure A.
b. The application in terms of 42(b) for the relaxation of the 3m common building line (adjacent to erf 3374) to 0.93m to allow for the proposed external staircase/braai and first floor balcony on erf 3375, Somerset West BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with Building Plan No. 04524/maree/ssw3375/rev01 – Dated May 2019 and subject to conditions in Annexure A.
c. The application in terms of 42(b) for the relaxation of the 3m common building line (adjacent to erf 3376) to 0m to allow for the proposed second dwelling (59sqm) on erf 3375, Somerset West BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with Building Plan No. 04524/maree/ssw3375/rev01 – Dated May 2019 and subject to conditions in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend 8.1.2 as follows:
The proposed second dwelling can be viewed as compatible in the subject area and will result in the optimal utilization of the property, with little negative impact on adjoining properties
