Resolution details

UNANIMOUSLY RESOLVED that:
a. The application for Rezoning of Erf 16782, Somerset West from Open Space Zone 3 to General Residential Subzone 2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.

b. The application for Permanent Departure in respect of erf 16782, Somerset West to permit a building line setback of 3.0m in lieu of 4.5m from Andries Pretorius Street, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The application for Permanent Departure in respect of erf 16782, Somerset West to permit a building line setback of 0m in lieu of 4.5m from Pastorie Road, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

d. The application for Permanent Departure in respect of erf 16782, Somerset West to permit a building line setback of 4.5m in lieu of 9.0m from the common building line (adjacent to Erf 7889), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

e. The application for approval of Site Development Plan No 1099_SDP_19 dated 26/02/2019 and Landscape Plan No 16782_LP_01_rev5 dated 9/07/2019 in respect of erf 16782, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend 6.1.6 as follows:

The proposed built form (scale and massing of building, design aesthetic) and proposed number of dwelling units are considered to be contextually appropriate.

Amend Annexure A as follows:
Delete condition 2.19

Amend paragraph 2.28 to read as follows:
That the remaining trees located on Council owned land shall not be removed or pruned without prior consultation with and approval from the Director: Parks and Recreation.


Amend condition 2.29 to read as follows:
That the approved detailed Landscape Plan shall be implemented by and at the cost of the Developer
