Resolution details
RESOLVED that:
a. The rezoning of Portion 29 of Farm 794, corner of R102 and N2, Somerset West, from Open Space Zone 3 to Subdivisional Area Overlay Zone, with underlying rights for General Business 3 Zone, Utility Zone and Open Space Zone 3, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto;
b. The subdivision of Portion 29 of Farm 794, corner of R102 and N2, Somerset West, into 5 portions, portion1, zoned General Business Zone 3 (approximately 7,6713ha in extent), portion 2, zoned General Business Zone 3 (approximately 1,2192ha in extent), portion 3, zoned Open Space Zone 3 (approximately 12,3076ha in extent), portion 4, zoned Utility Zone (approximately 0,028ha in extent) and portion 5, zoned Open Space Zone 3 (approximately 1,2507ha in extent), in accordance with plan of subdivision no. ST29-794/04, dated 13/04/2018, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A hereto;
c. A permanent departure on Portion 29 of Farm 794, corner of R102 and N2, Somerset West, to permit a combined entrance and exit carriageway crossing of 15,4m, in lieu of the required 8m maximum width, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A hereto;
d. A permanent departure on Portion 29 of Farm 794, corner of R102 and N2, Somerset West, to enable the ground floor of buildings on portions 1 and 2 of the subdivision, to be raised more than 1,5m above existing ground level, i.e. between 1.87m and 2.623m, in lieu of the required 1.5m, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A hereto.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report amend reason 1
1. The proposed development is consistent with the MSDF and complies with the guidelines as set out in the City’s spatial planning policies which promote urban restructuring and spatial and socio- economic integration
