UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 3 000.00 for the unauthorised land use (tavern) and an administrative penalty in the amount of R 700.00 for the unauthorised building in terms of Section 129 and 42(r) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 20357, 92 Ben Moloise Crescent Mandela Park, Khayelitsha BE DETERMINED, in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:

6.5 The gravity of the contravention is considered to be serious because the activity poses a potential health risk and fire hazard
