RESOLVED UNANIMOUSLY

a. That the application for a departure, as set out in Annexure A, for Erf 90263 Cape Town at Kalk Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. That the application for Council’s approval in terms of Item 162(1) of the Development Management Scheme, to permit building work within a heritage protection overlay zone, as set out in Annexure A, for Erf 90263 Cape Town at Kalk Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. That the application for Council’s approval in terms of Item 121(2) of the Development Management Scheme, to permit building work within 5m from a designated metropolitan road, as set out in Annexure A, on Erf 90263 Cape Town at Kalk Bay, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
