RESOLVED UNANIMOUSLY
a. That the application for deletion of restrictive title deed conditions, as set out in Annexure A, for Erven 97231 & 97248 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. That the application for consolidation of Erven 97231 & 97248 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per the plan of subdivision and consolidation LUM/00/97231.
c. That the application for the subdivision of the consolidated Erven 97231 & 97248 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as per plan of subdivision and consolidation LUM/00/97231, subject to the conditions contained in Annexure A.
d. That the application for departures, as set out in Annexure A, for Erven 97231& 97248 Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:
7.1.11 The consolidation of the two erven will not result in an inappropriate massing.
