UNANIMOUSLY RESOLVED that:
An administrative penalty ni the amount of R 65 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 11040, Milnerton, for the unlawful building work, and such penalty BE APPROVED in terms of Section 98(b) of the said By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:
6.5 The owner willfully extended building work in a protected area
6.6 The area of contravention is considered to be very large
