UNANIMOUSLY RESOLVED that:
a. The rezoning of erven 4594 and 4627, Milnerton from General Residential Subzone GR3 to General Residential Subzone GR4, BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015 subject to the conditions contained in the attached Annexure A.

b. The regulation departures as set out in Annexure A in respect of erven 4594 and 4627, Milnerton, BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015.

c. Council’s consent in terms of title deed condition B.B.(e) for erf 4627, Milnerton and condition B.(e) for erf 4594, Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

d. Councils approval for an exempted subdivision (right of way servitude) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

e. The site development plans for erven 4594 and 4627, Milnerton as per Annexure D, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

2. CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BY-LAW IN RESPECT OF ERF 4594 AND 4627 MILNERTON

3.4 In terms of section 8.1 of the Development Charges (DC) Policy for Engineering Services for the City of Cape Town (Approved Policy C41/05/14-29 May 2014) development charges apply to this application. The total amount payable for the proposed limited land use right of 58 flats which incorporates erf 4594 and 4627 Milnerton, in accordance with the attached DC calculation of R 215 500.54 for erf 4594 and R 215 500.54 for erf 4627 amounts to R 431 001, 08. It must be noted that the amount due will escalate annually on 1 July with the Construction Price Adjustment formula (CPAF) using the industry indices of StatsSA. Should the developer intend to increase the development in future, additional development contribution charges will be levied.

Parties were advised of their right of appeal.
