Resolution details

UNANIMOUSLY RESOLVED that:
a. The application for the street building line departure in respect of Erf 975, 3 Roseberry Avenue, Oranjezicht, BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law in accordance with attached Annexure A.

b. The application for the deletion of a restrictive title deed condition in respect of Erf 975, 3 Roseberry Avenue, Oranjezicht, BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law in accordance with attached Annexure A.

c. The application for the deletion of a condition of an existing approval in respect of Erf 975, 3 Roseberry Avenue, Oranjezicht, BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law in accordance with attached Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:

7.1.7 The decision-making criteria contained in Section 47 of SPLUMA and Section 39(5) of LUPA are complied with

Correct heading above paragraph 1.4 as follows:
The deletion of the following condition in respect of an existing approval granted or deemed to have been granted in terms of the Municipal Planning By-Law:
