UNANIMOUSLY RESOLVED that:
a. The application for the deletion of title deed restrictions as contained in Annexure A attached in respect of Erven 689 and 690, cnr Beach and Hall Roads, Sea Point West BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with conditions contained in Annexure A
b. The application for the approval of Council for those applications as contained in Annexure A attached in respect of Erven 689 and 690, cnr Beach and Hall Roads, Sea Point West BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law 2015 in accordance with conditions contained in Annexure A
c. The application for the Council’s Consent for the applications as contained in Annexure A attached in respect of Erven 689 and 690, cnr Beach and Hall Roads, Sea Point West BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law 2015 in accordance with conditions contained in Annexure A
d. The application for the Departures for the applications as contained in Annexure A attached in respect of Erven 689 and 690, cnr Beach and Hall Roads, Sea Point West BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law 2015 in accordance with conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend the last bullet point as follows:
The deletion of the title deed condition will still see the Municipal Planning By-Law be the control to guide any future development of the site
Add new reason:
The proposal is regarded as being desirable and satisfies the assessment criteria contained in Section 99(3) of the Municipal Planning By-Law
Amend Annexure A:
Add new 5.5 as follows:
The requirements relating to an onsite signalized vehicular circulation system, as required by the Transport Department, shall be complied with.
Add new condition 5.6 as follows:
Measures shall be put in place for vehicles entering onto erf 690 to have preference over vehicles leaving, to the satisfaction of the authorized official.
