UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 4 000.00 for the unauthorized land use and building work, BE DETERMINED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 910, 95 Fagan Street, Strand
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 2 as follows:
The owner did not take the initiative to consult the Development Management office to ensure that the necessary approvals are in place. The owner took the initiative to legalize the unauthorized land use and building work by submitting an application to get the necessary approvals once she was made aware of the contravention.
