Resolution details

UNANIMOUSLY RESOLVED that:
a. The application for the rezoning of Erf 5236, corner of Beach Road and Drake Road, Strand, from General Residential Zone 5, to Local Business Zone 2, in order to regularize the existing land uses on the property, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto;

b. The application for a consent on Erf 5236, corner of Beach Road and Drake Road, Strand, to permit a restaurant on the ground floor level of the premises, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto;

c. The application for the permanent departures on Erf 5236, corner of Beach Road and Drake Road, Strand, to allow for reversing of vehicles across the sidewalk along Drake Road; more than a single motor vehicle carriageway crossing along Drake Road; a motor vehicle carriageway crossing along Drake Road, narrower than the minimum width (2.5m in lieu of the required 2.7m); for a reduction of the minimum access distance from an intersection (4.681 in lieu of the required 10m); for the spacing of carriageway crossings to be less than 12m apart BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto.

d. The application for permanent departure, in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015, for the under-provision of on-site parking (8 bays in lieu of the required 23 bays) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend:

7.4 Services infrastructure exists to support the development proposal

7.7 The proposal will make a positive contribution to the character and ambiance of the Beach Road precinct, which functions as an interface with Beach front recreation amenities

Correct numbering sequence in the case officer’s report

Amend Annexure A:
Add 1.4: The application for permanent departure, in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015, for the under-provision of on-site parking (8 bays in lieu of the required 23 bays)
