UNANIMOUSLY RESOLVED that:
The application for a temporary land use in terms of Section 42(c) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit a business premises for the operation of an air conditioning and refrigeration business on portion of erf 52, 13 Herbert Penny Road, Penhill, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as set out in the attached Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to:
Amend 7.2: The proposed scale and nature of activity is compatible with the surrounding land use character in the short term until the temporary use is relocated
Amend 7.3: The activity will have some positive local economic development benefits for the area due to job creation.
Add new: The shorter duration will enable the relevant departments to monitor the impact of the land use
Delete 7.1
Correct the numbering sequence.
Amend Annexure A
Add new 2.9: That this temporary departure will be valid for a period of 2 years
Delete 2.5 and replace with:
The primary use of the property must remain residential
