That an administrative penalty in the amount of R100 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 797 Constantia regarding the unauthorised hotel and building work on the property as per the plans drawn by Barry M. Abrahams Architecture, numbered 8361.1, 8361.2, 8361.3 and 8361.4 all revision D, all dated February 2019.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 6.7 which is amended as follows:
6.7. The current owner has previously contravened this By-Law and paid a penalty.
