Resolution details

UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 2 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 5353, Milnerton, in respect of the place of instruction, and such penalty BE APPROVED in terms of Section 98(b) of the said By-Law.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend as follows:

6.2 The owner has taken the necessary steps to regularize the unauthorized activity upon being made aware of the contravention. The conduct of the operator is therefore not regarded as willful.

6.4 Council has not had the opportunity to verify compliance with its requirements due to the land use process not being finalized prior to operations starting. The gravity is therefore considered to be moderately serious.
