UNANIMOUSLY RESOLVED that:
a. The removal of the restrictive title deed conditions as set out in Annexure A in respect of erven 1522 and 1523, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The removal of the restrictive title deed condition as set out in Annexure A in respect of erven 1522 and 1523, Milnerton, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

c. The amendment of the original town establishment conditions as set out in Annexure A in respect of erven 1522 and 1523, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

d. The amendment of the original town establishment conditions as set out in Annexure A in respect of erven 1522 and 1523, Milnerton, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015

e. The rezoning from Single Residential 1 (SR1) to General Residential 1 (GR1) of erven 1522 and 1523, Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

f. The consolidation of erven 1522 and 1523, Milnerton in accordance with Annexure D, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.

g. The subdivision of the consolidated erven 1522 and 1523 Milnerton into 11 portions, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no Erf1522/3_Sub3, dated 22 November 2018 prepared by K Burger attached as Annexure E, subject to the conditions contained in Annexure A.

h. The regulation departures as set out in Annexure A in respect of consolidated erven 1522 and 1523 Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

i. The site development plan for the consolidated erven 1522 and 1523 Milnerton, as per Annexure C, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.

REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report and agreed to amend 7.3.8 as follows:

The proposed development predominantly supports the implementation of the Transport Oriented Development Strategic Framework by promoting the use of the IRT system by allowing a higher density development with ease of access to and from public transport.

Amend Annexure A:
1.1. Deletion of restrictive title deed conditions C.9.(b); C.9.(c); C.9.(d)(i); C.9.(d)(ii); C.9.(e), C.10 and B.9.b), B.9.c), B.9.d)(1)(2), B.9.e); B.10, as contained in Title deeds relating to erf 1522 and 1523, Milnerton, respectively.
