UNANIMOUSLY RESOLVED that:
a. The application for subdivision and consolidation in respect of Erven 3326 and 416, Oranjezicht, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application for rezoning, City approval (HPOZ) and departures for Erven 3326 and 416, Oranjezicht, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as set out in Annexure A

REASONS FOR DECISION
The MPT APPROVED application for the reasons set out in the Planner’s Report and agreed to amend:

7.2.1 The application meets the criteria in Section 99(1) of the By-Law

Delete reasons 7.2.1 – 7.2.5

Add new reasons:
The impact of the building line departures is not significant
The adjacent neighbours are not materially negatively impacted upon
The proposal is considered to be desirable in terms of the criteria contained in Section 99(3)

Update numbering sequence accordingly.



Amend Annexure A:
2 APPLICATIONS APPROVED IN TERMS OF SECTION 99(B) OF THE BY-LAW
2.2.1 Item 41(a): Departure to permit a coverage of 60.8% in lieu of 60%

Add:
The rezoning relates to the building plans as indicated in Addendum 3 on folios 17 to 28 of the supplementary report

That the green wall proposal and its aesthetic treatment be referred to the relevant department for approval by the Director: Development Management

That the street interface be improved in consultation with the Urban Design Department and finalized, to the satisfaction and approval of the Director, Development Management

That the developer/owner is responsible for a DC amount of R 210 754.03

The building envelopes be limited as indicated on the amended plans

Parties were advised of their right of appeal.
