Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for rezoning of a 2.9124ha portion of Remainder Cape Farm 1165 (Groot Phesantekraal) from Agricultural Zone to Subdivisional Area Overlay Zone in terms of Section 42(a) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Plan No. 712-2 Rev 5, dated 06/12/2018 and attached as Annexure C, and subject to the conditions contained in Annexure A.

b. The application for consolidation of Erf 21679, Kraaifontein with Remainder Cape Farm 1165 (Groot Phesantekraal) in terms of Section 42(f) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Consolidation Plan No. 712-5 dated 18/02/2019 and attached as Annexure D, and subject to the conditions contained in Annexure A.

c. The application for amendment of Condition 1.2 of the approval dated 17 August 2015 relating to Graanendal Phase 4 in order to amend the approved Master Plan to accommodate an education precinct and associated student accommodation in terms of Section 42(j) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Plan No. 712-2 Rev 5, dated 06/12/2018 and attached as Annexure C, and subject to the conditions contained in Annexure A.

d. The application for subdivision of the consolidated Erf 21679, Kraaifontein and Remainder Cape Farm 1165 (Groot Phesantekraal) into 25 portions consisting of 3 portions zoned Community Zone 2, 3 portions zoned Mixed Use Zone, 3 portions zoned General Residential Zone 2, 2 portions zoned Subdivisional Overlay Zone, 5 portions zoned Open Space Zone 3 (private open space), 2 portions zoned Transport Zone 2 (public roads), 6 portions zoned Utility Zone (electrical substations), and a Remainder zoned Agricultural Zone in terms of Section 42(d) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Plan No. 712-3 Rev 6, dated 14/02/2019 and attached as Annexure E, and subject to the conditions contained in Annexure A.

e. The application for the implementation of a subdivision approval in phases in terms of Section 42(e) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Phasing Plan No. 712-4 Rev 3 dated 11/12/2018 and attached as Annexure F, and subject to the conditions contained in Annexure A.

Condition 10.11 be deleted

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason that reads as follows:

7.1.9 That bulk water, sanitation, electricity and engineering services are available
