RESOLVED UNANIMOUSLY:

That an administrative penalty for unauthorised building work in the amount of R68 094.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 103325, Cape Town.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out as set out below

1. The gravity is serious because the unauthorized building work and structures significantly contravene the Development Management Scheme also in respect of coverage and on-site parking.
2. The owner of the property was fully aware of the rules and procedures required to obtain Council’s approval, prior to commencement of any construction on the premises but continued with the unauthorized building works.
3. The unauthorized structures have been in existence for the past 4 years. Which is of a long duration?
4. The contravention is of a large extent measured at 483m2
5. The conduct of the owner in refusing to apply for the administrative penalty as required in terms of the By-Law is viewed in a serious light
6. The owner has not offered any information / motivation for the significant contravention of the Municipal Planning By-Law
