RESOLVED UNANIMOUSLY

a. That the application for the consolidation of Erf 35134 and Erf 35135 Cape Town BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.

b. That the application for the rezoning of Erf 35134 and Erf 35135 Cape Town from Single Residential 1 Use Zone to General Residential 4 Use Zone BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A attached hereto.

c. That the application for permanent departures (as set out in Annexure A attached hereto) on Erf 35134 and Erf 35135 Cape Town BE APPROVED in terms of Section 98 (b) of the City of Cape Town Municipal Planning By-law, 2015 in accordance with the Plan Numbers IJ 15/11, Pages 01-08, Revision F, dated 02 February 2017 drawn by I Jacobs and Associates and attached hereto as Annexure C, subject to the conditions contained in Annexure A attached hereto.

Correction:

1.3.1 Building lines:

a. To permit the buildings to be setback 2,5m and 3.0m in lieu of the 4,5m from the Carnie Road street boundary.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.1.1 which is amended and two additional reasons added

7.1.1. The rezoning of the property from Single Residential 1 Use Zone to General Residential 4 will allow for the efficient use of the property that is in line with the City’s Municipal Spatial Development Framework (2018), the Cape Flats District Plan (2012), the Densification Policy and the City’s TOD Strategic Framework. The consolidation allows for a larger site area which facilitates a more effective design for the proposed flats.
7.1.6 The proposal satisfies the desirability criteria in terms of Section 99 in the Municipal Planning Bylaw as listed in paragraph 6.1.4 of the report.
7.1.7 The massing of the building is similar to other buildings in Carnie Road and would have minimal impact
