RESOLVED UNANIMOUSLY

The application for consent use to operate a day care facility from erf 5643, Kuilsrivier, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, for the reasons as set out in this report and subject to conditions as set out below.

CONDITIONS OF APPROVAL:

1. That the number of children in the day care center be limited to 34
2. Hours of operation be limited between 06:30am to 18:00 from Monday to Fridays
3. ECD center be closed on Saturdays, Sundays and public holidays.
4. That the developer/owner provide 3 on-site parking bays as well as the drop off zone as indicated on the site plan
5. That an evacuation plan be submitted by the applicant in the event of flooding to the satisfaction of the relevant department.
6. The owner needs to acknowledge the fact that the approval is granted despite the fact that the building falls within the 100 year floodline and that the operator will make all of the learner’s parents aware of that fact.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out below

1. The establishment of the ECD’s is of crucial importance in terms of Council’s Social Development Policy.
2. The impact of the ECD in terms of traffic, surrounding uses and character of the area is not materially significant.
3. Adequate safety and mitigation evacuation measures can be implemented by the applicant.
4. The building footprint of the structures is not being increased.
5. The ECD will have a positive impact on childhood education, job creation and proximity to other community facilities.
6. Although the proposal does not comply with the 2009 Floodline and River Corridor Management Policy, the deviation from such policy is considered to be reasonable and minor in this instance. The portion of the property where the building is situated falls outside of the high hazard zone.
