RESOLVED UNANIMOUSLY that:

a. The application for rezoning of Portion 32 of Cape Farm 168 from Agricultural Zone to Subdivisional Area Overlay Zone in terms of Section 42(a) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Subdivision / Zoning Plan No. 6 Rev 7, dated 01/10/2018 and attached as Annexure C, and subject to the conditions contained in Annexure A.

b. The application for subdivision of Portion 32 of Farm 168 into 10 portions to accommodate a light industrial development consisting of 6 General Industrial Zone 1 erven, 1 Open Space Zone 3 erf, 2 Transport Zone 2 erven, and 1 Utility Zone erf in terms of Section 42(d) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Subdivision / Zoning Plan No. 6 Rev 7, dated 01/10/2018 attached as Annexure C, and subject to the conditions contained in Annexure A.

c. The application for subdivision of Portion 33 of Farm 168 into 2 portions (Portion A and Remainder) in terms of Section 42(d) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Subdivision / Zoning Plan No. 7A Rev 4, dated 09/11/2015 attached as Annexure D, and subject to the conditions contained in Annexure A.

d. The application for rezoning of Portion A (a portion of Portion 33 of Cape Farm 168) from Agricultural Zone to Subdivisional Area Overlay Zone in terms of Section 42(a) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Subdivision / Zoning Plan No. 7B Rev. 4, dated 09/11/2015 attached as Annexure E, and subject to the conditions contained in Annexure A.

e. The application for subdivision of Portion A (a portion of Portion 33 of Farm 168) into 3 portions consisting of 1 General Industrial Zone 1 erf and 2 Transport Zone 2 erven in terms of Section 42(d) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Subdivision / Zoning Plan No. 7B Rev. 4, dated 09/11/2015 attached as Annexure E, and subject to the conditions contained in Annexure A.

f. The application for consolidation of Portion 1 of Portion A (a portion of Portion 33 of Farm 168) with Portion 3 of Portion 32 of Farm 168 in terms of Section 42(f) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Consolidation Plan No. 10 Rev. 4 dated 03/10/2018 and attached as Annexure F, and subject to the conditions contained in Annexure A.

g. The application for consolidation of Portion 3 of Portion A (a portion of Portion 33 of Farm 168) with Portion 8 of Portion 32 of Farm 168 in terms of Section 42(f) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Consolidation Plan No. 10 Rev. 4 dated 03/10/2018 and attached as Annexure F, and subject to the conditions contained in Annexure A.

h. The application for consolidation of Portion 3 of Portion A (a portion of Portion 33 of Farm 168) with Portion 9 of Portion 32 of Farm 168 in terms of Section 42(f) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Consolidation Plan No. 10 Rev. 4 dated 03/10/2018 and attached as Annexure F, and subject to the conditions contained in Annexure A.

i. The application for the implementation of a subdivision approval in phases in terms of Section 42(e) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Phasing Plan No. 9 Rev. 1, dated 21/01/2018 and attached as Annexure G, and subject to the conditions contained in Annexure A.

Condition 2.3.5 is amended as follows:

2.3.5 That the area of land that forms part of Portion 32 of Farm 168 and that is required for a future regional stormwater facility, be transferred to the Municipality, prior to building plan submission

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reasons 7.1.5 and 7.1.6 which are amended as follows:

7.1.5. The proposed development will not have an adverse impact on traffic in the area. Any potential traffic impact will be mitigated by the proposed road network improvements as per the attached Annexure A, contained in Addendum 5 (page 744)
7.1.6. The relevant internal departments considered the application in terms of their field of expertise and support the application, subject to conditions which are regarded to sufficiently mitigate any potential impacts, as per the attached Annexure A contained in Addendum 5 (page 744 )
