RESOLVED UNANIMOUSLY

a. That the application for rezoning of Portion 6 of Farm No. 420, Kuilsrivier, from Agricultural Zone to Subdivisional Area, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with subdivision plan no. STELL420-6/SUB/MAY2018/1, dated “May 2018”, drawn by Atlas Town Planning, subject to the conditions attached as annexure A.

b. That the application for subdivision of Portion 6 of Farm No. 420, Kuilsrivier, into 46 General Residential 1 zoned erven and 4 Open Space 3 zoned erven (inclusive of the street names), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with subdivision plan no. STELL420-6/SUB/MAY2018/1, dated “May 2018”, drawn by Atlas Town Planning, subject to the conditions attached as annexure A.

c. That the application for permanent departure from the City of Cape Town Development Management Scheme in respect of Portion 6 of Farm No. 420, Kuilsrivier, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in order to permit a 3m building line along Bruno Street in lieu of the applicable 5m building line, in accordance with the site development plan no. 1129_OM_SDP01(01_03), dated “Sept 2017”, drawn by Johan van Zyl Architects, subject to the conditions attached as annexure A.

d. That the application for consent use in respect of Portion 6 of Farm No. 420, Kuilsrivier, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in order to permit a utility service (stormwater retention pond) on Portion 50, as indicated on the site development plan, no. 1129_OM_SDP01(01_03), dated “Sept 2017”, drawn by Johan van Zyl Architects, subject to the conditions attached as annexure A.
e. That the proposed site development plan in respect of Portion 6 of Farm No. 420, Kuilsrivier, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with plan no. 1129_OM_SDP01(01_03), dated “Sept 2017”, drawn by Johan van Zyl Architects, subject to the conditions attached as annexure A.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons in the Planner’s report except reasons 7.1.4 and 7.1.8 are amended and added an additional reason which reads as follows:

7.1.4. The proposal will not have a significant negative impact especially with regard to abutting properties privacy and sunlight, as it is a single storey, inward orientated development, which complies with the required setbacks along the borders of existing developments.
7.1.8 The proposed development will be subject to all applicable safety and health regulations, and is therefore not likely to materially impact on the safety, health and wellbeing of the surrounding community.
7.1.9 The proposal is compliant with the desirability criteria in Section 99 of the Municipal Planning By-Law.
