RESOLVED UNANIMOUSLY
a. That the application for permanent departure in respect of Erf 38537, Bellville, to permit the relaxation of the on-site parking requirements to 92 bays provided in lieu of 148 parking bays required to accommodate118 residential apartments, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with site development plans, attached as Annexure B, subject to the conditions contained in Annexure A.
b. That the application for permanent departure to permit the relaxation of the street building line to 1.5m in lieu 4.5m to accommodate a balcony area, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with site development plans, attached as Annexure B, subject to the conditions contained in Annexure A.
c. That the application for permanent departure to allow entrance steps and a wall to be 6.5m from the street centreline in lieu of 8.0m, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with site development plans, attached as Annexure B.
d. That the application Council’s consent to provide parking within 10m from the street boundary abutting DJ Wood Street, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with site development plans, attached as Annexure B.
Condition 3 is amended as follows:
3. The development shall be limited to a residential facility for 118 occupants.
Conditions 2, 8 and 9 are deleted
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons in the Planner’s report except reasons 7.1.3 and 7.1.4 which are amended as follows:
7.1.3 The parking and building setback departures will not have any material negative impact on the surrounding area;
7.1.4 The provision of parking within 10m of the street boundary is insignificant, as the parking is set back behind other active functions, thus complying with the Urban Design Policy.
