RESOLVED UNANIMOUSLY that:
a. The application for rezoning of Portion 42 of Cape Farm 168 from Agricultural Zone to Subdivisional Area Overlay Zone in terms of Section 42(a) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Drawing No HS 100395-02: Zoning Plan 2018 Rev. 19 attached as Annexure D, and subject to the conditions contained in Annexure A.
b. The application for subdivision of Portion 42 of Farm 168 into 34 portions to accommodate a light industrial development consisting of 30 General Industrial Zone 1 erven and 4 Open Space Zone 3 erven in terms of Section 42(d) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Drawing No HS 100395-03: Subdivision Plan 2018 Rev. 19 attached as Annexure C, and subject to the conditions contained in Annexure A.
c. The application for the implementation of a subdivision approval in phases in terms of Section 42(e) of the Municipal Planning By-Law 2015, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with Drawing No HS 100395-04: Phasing Plan 2018 Rev. 02 attached as Annexure E, and subject to the conditions contained in Annexure A.
d. The application for consent in terms of the Title Deed in terms of Section 42(h) of the Municipal Planning By-Law 2015, to permit the property to be used for purposes other than that of a quarry, BE APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report except reasons 7.1.8 which is deleted
