RESOLVED UNANIMOUSLY

a. That the application for rezoning of erf 5314, Goodwood, from Single Residential 1 to Local Business 1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the site layout plan, no. Uthetha Telcoms 17-100, drawn by Malcolm Povey Architectural Designs, subject to compliance with the conditions attached as annexure A.

b. That the application for permanent departure in respect of erf 5314, Goodwood, in order to relax the 3,0m common boundary building line to 1,22m and 0m to permit an office and store respectively and the 3,5m street boundary building line to 0,6m to accommodate a shade port BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, only in so far as to allow the existing structures to be used as specified, in accordance with the site layout plan, no. Uthetha Telcoms 17-100, drawn by Malcolm Povey Architectural Designs, subject to compliance with the conditions attached as annexure A.

Applications granted 1.2 is amended as follows:

1.2 Permanent departures in order to allow the relaxation of the 3,0m common boundary - to 1,22m and 0m to permit an office and store respectively and 3,5m street boundary building lines to 0, 6m to accommodate a shade port , only in so far as to accommodate the existing structures to be used as specified on the Site Layout Plan.












REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report and added an additional reason 7.7

7.1.7 The proposal satisfies the desirability criteria contained in Section 99 of the Municipal Planning Bylaw
