RESOLVED UNANIMOUSLY
a. That the application for the removal of restrictive title conditions B3(a), (b), (c), (d) and amendment of C(iv) of Title deed T582/2005 relating to Erf 1095, Durbanville BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.
b. That the application for the deletion and amendment of the conditions of the planning approval of the Township as removed per paragraph 8.1 in respect of Erf 1095, Durbanville BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law, 2015.
c. That the application for subdivision of Erf 1095, Durbanville, into a Portion (1048m²) and a Remainder (1010m²) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with the attached Annexure C and subject to the conditions contained in Annexure A.
d. That the application for departure to relax the eastern common building line of Portion 1 from 3m to 1m to accommodate a scullery, bathroom and study BE APPROVED in terms of Section 98 of the Municipal Planning Bylaw in accordance with the attached Annexure C.
Conditions 2.2 and 2.3.4 are deleted
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons in the Planner’s report added an additional reason that reads as follows:
7.6 The proposal satisfies the principles and criteria for removal of restrictions contained in Section 47 of SPLUMA and Section 39(5) of LUPA
