Resolution details

RESOLVED UNANIMOUSLY

a. That the application for the amendment of the conditions of approval (dated 1998 per Annexure H of the MPT report) relating to:

- The floor factor of 0.5 to 0.82; and

- The permissible height from one storey to four storeys

in order to accommodate 127 flats in respect of Erf 11892, Durbanville, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the Site Development Plan attached as Annexure C1 and subject to the conditions contained in Annexure A.

b. That the provision of parking closer than 10m to the street boundary per the SDP attached as Annexure C1 BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015.

Conditions 2.4 and 2.5.2 are amended as follows:

2.4 The development shall be implemented generally in conformance with the approved Site Development Plan attached as Annexure C1, namely: SDP001 dated 21 April 2017, Rev D – 3 July 2018. ; LDP001, dated 21 April 2017, revision D- 3 July 2018, LDP002, dated 2 July 2018, GA 000 - 002, dated 20 April 2017, Rev C, GA 003, dated 20 April 2017, Rev B, GA 005, dated 20 April 2017, Rev B, GA 101, dated 20 April 2017, rev C, GA 201, dated 20 April 2017, rev C and GA 301, dated 20 April 2017, rev B.
2.5.2 That DC's will be payable prior to approval of building plans.

Condition 2.5.4 is deleted

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons in the Planner’s report and added an additional reason that reads as follows:

7.8 The amendment of the previous conditions of approval satisfies the desirability criteria contained in Section 99 of the Municipal Planning Bylaw
