UNANIMOUSLY RESOLVED that:
a. The application for a consent use in terms of item 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the operation of a house shop from erf 3028, Malibu Village, Blue Downs BE APPROVED in terms of Section 98(b) (iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions as set out in the attached Annexure A.
b. The application for the permanent departure in terms of item 42(b) of the City of Cape Town Municipal Planning By-Law, 2015, to permit a setback of 1.0m in lieu of 3.5m from Trafalgar Street for the house shop, on erf 3028, Malibu Village, Blue Downs, BE APPROVED in terms of Section 98(b) (i) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
