UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 6 000.00 for the unauthorised land use (the additional 17 guest rooms) in term of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 1777,12 Hermes Way, Ikwezi Park, Mandalay BE DETERMINED in term of Section 98(b)i of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reason set out in the Planner’s Report and agreed to:
Amend 6.1: The unauthorised use of the guest house has been operating since 2016 and is considered longstanding.
Add new 6.4: The gravity is considered to be serious
