RESOLVED UNANIMOUSLY

a. That the application for consolidation of Erven 2641 and 2643 Constantia, as per plan of consolidation LUM/16/2641C, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. That the application for rezoning of Erven 2641 and 2643 Constantia, from Single Residential Zone 1 to General Residential Subzone GR1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

Condition 2.2.3 is amended as follows

2.2.3 Prior to the approval of any building plans for the retirement village, the owner shall submit to the Director: Development Management a formal application for a Site Development Plan (SDP) as provided for in Item 123 of the Development Management Scheme (DMS) (in order to comply with the provisions of Item 36 of the DMS). The said SDP shall be generally in accordance with the plans attached as Annexure F to the Departmental report to the Municipal Planning Tribunal with case ID 70342068 and that the officials and applicant give specific consideration to the layout/design of units 1 – 6.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
