Resolution details

UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 4 000.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 2855, Montague Gardens, Summer Greens in accordance with Drawing no. Hm-2; dated 2018/06/11, attached as Annexure B, for the unlawful second dwelling conversion, and approved in terms of Section 98(b) of the said By-Law (2015).

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend as follows:

6.3: An unlawful structure which is occupied without approval, could pose a threat to the safety, health and wellbeing of the surrounding community.
