RESOLVED UNANIMOUSLY

a. That an administrative penalty in the amount of R0 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised building work on Erf 89622 Cape Town at Kalk Bay, as shown on the plan with project number 2017.1832.3, sheets A101 & A102, drawn by Design Men Pty Ltd, dated 27/09/2017.

b. That an administrative penalty in the amount of R2500.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised ground floor shops on Erf 89622 Cape Town at Kalk Bay, as shown on the plan with project number 2017.1832.3, sheets A101 & A102, drawn by Design Men Pty Ltd, dated 27/09/2017.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the
Planner’s report except reason 6.3 which is deleted and reason 6.4 which is amended as follows:

6.4 The gravity of the contravention is moderately serious when considering the scale and nature of the land use, and considering that the property is located in a heritage protection overlay zone.
