RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R10 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 799 Grassy Park for the bedrooms, store room, carports & ECD Centre on Erf 799 Grassy Park.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out below:

1. The bedrooms, store room and carports are unauthorized and contravene Items 22(d) & 22(f) of the Development Management Scheme.
2. The property is being used as a large ECD Centre with a 100 children and contravenes the Development Management Scheme.
3. The contravention is of a medium duration.
4. The gravity of the contravention is very serious.
5. As far as can be ascertained, the owner of the property has not previously contravened this By-Law or any other planning law.
6. The applicant provided misleading information by not showing the ECD on the plan
