RESOLVED UNANIMOUSLY

That an administrative penalty in the amount of R85 500 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 63024 Cape Town at Lansdowne in accordance with plan no – DRAWING NUMBER: 0562 attached hereto as Annexure B.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out below:

1. The duration is very long and the gravity of the contravention is considered to be extremely serious.
2. The owner willfully contravened the City of Cape Town Municipal Planning By-Law despite the refusal of the land use application and the dismissal of the appeal
3. The owner is well aware of the land use processes required to obtain the necessary approvals.
