UNANIMOUSLY RESOLVED that:
a. The application for amendment of title deed condition C.8(d) contained in title deed T41422/2016 on erf 1516, Milnerton as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in the attached Annexure A.
b. The application for amendment of the original town establishment condition to permit a structure closer than 1.57m from the lateral boundary on proposed portion A, a portion of erf 1516, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in the attached Annexure A.
c. The application for Council’s consent as required in terms of title deed conditions C.8(e) and C.9 contained in title deed T41422/2016 on erf 1516, Milnerton as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in the attached Annexure A.
d. The subdivision of erf 1516, Milnerton, into two portions measuring 1115m² and 511m², BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with plan no Mil1516.dwg, dated June 2017 prepared by RvB Geomatics Inc., subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
