Resolution details

UNANIMOUSLY RESOLVED that:

The application for departures, as set out in Annexure A, for erf 4408, Milnerton BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A, in accordance with plans in Annexure C.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

Amend Annexure A:
1. APPLICATIONS GRANTED IN TERMS OF SECTION 98(b) OF THE BY-LAW

1.1. Item 41(e): To permit a portion of the building (below 25m in height from base level) to be 3.3m in lieu of 4.5m from the northern common boundary, as per annexure C.
1.2. Item 41(e): To permit a portion of the building (below 25m in height from base level) to be 3.3m in lieu of 4.5m from the eastern common boundary as per annexure C.
1.3. Item 137: To permit 23 on-site parking bays in lieu of 34, as per annexure C.

2. CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BY-LAW

2.1. RELATING TO THE REGULATION DEPARTURES

ENVIRONMENTAL MANAGEMENT DEPARTMENT

2.1.1 A detailed Landscape Plan, generally in accordance with the draft landscape plan no. 05/17 – XP – 105, dated 12 April 2018, must be submitted by the owner/developer as part of the building plan to the Director: Development Management for approval.



2.1.2 Implementation of the detailed landscaping plan shall be to the satisfaction of the Director: Development Management (or his/her delegate). An on-site meeting must be arranged for this purpose with the Director: Development Management on completion of such landscaping.
