RESOLVED UNANIMOUSLY

a. That the application for Subdivision of remainder erf 1940 into two portions, Portion 1 and Remainder BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with the Subdivision Plan LP-5662-LP-01-Rev A dated 22 November 2017, subject to conditions contained in Annexure A.

b. That the application for Subdivision of remainder erf 1449 into two portions, Portion 1 and Remainder BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, in accordance with the Subdivision Plan LP-5662-LP-01-Rev A dated 22 November 2017, subject to conditions contained in Annexure A.

c. That the application for Consolidation of Portion 1 (Erf 1940-RE) and Portion 1 (Erf 1449-RE) to create the “Development Area” BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the Consolidation Plan CP-5662-01-Rev A dated 22 November 2017 subject to conditions contained in Annexure A.

d. That the application for Rezoning of the consolidated “Development Area” from Limited Use to Subdivisional Area Overlay Zone BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the Subdivision Plan LP-5662-02-Rev A dated 22 November 2017 subject to conditions contained in Annexure A.

e. That the application for Subdivision of the consolidated “Development Area” into 166 portions BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the Subdivision Plan LP-5662-02-Rev A dated 22 November 2017 subject to conditions contained in Annexure A.

Conditions 2.1.3, 2.1.4 and 3.3.1 are amended as follows:

2.1.3 Boundary fencing shall be constructed around the development area in accordance with Council’s Boundary Walls and Fences policy (2009), prior to registration of the first erf arising after the subdivision. Building plans for the boundary fencing shall be submitted with final building plans for approval by the District Manager: Cape Flats District, and shall indicate inter alia the pedestrian gates in the layout.

2.1.4 The corner of each newly created erf within the development area shall be demarcated with a concrete post prior to the commencement of any top structure construction.

3.3.1 The owner shall compile a stormwater management plan in accordance with the Management of Urban Impact Policy (2009) and shall be submitted to Catchment Management prior to any earth works. It must include:

- An environmental buffer of 10m from the top of bank, running parallel to the canal must be adhered to.

- Overland escape routes shall be clearly defined and indicated.

REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 7.1.7 that reads as follows:

7.1.7 There are no heritage issues or material environmental issues that would impact the development of the site.
