RESOLVED UNANIMOUSLY
a. That the application for rezoning from Single Residential zone (SR1) to Community zone (CO1) in respect of Erf 8584, Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to conditions as stipulated in attached Annexure A.
b. That the application for consent use in respect of Erf 8584, Milnerton to allow for the erection of a 21 m high freestanding mast and telecommunication base station BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to conditions as stipulated in attached Annexure A.
c. That the application for permanent departure in respect of Erf 8584, Milnerton involving the relaxation of the 5 m street building line to 0m BE REFUSED in terms of Section 98(c) of the Municipal Planning By-law, 2015.
2. APPLICATIONS REFUSED IN TERMS OF SECTION 98(c) OF THE BYLAW
2.1 Permanent departure involving the relaxation of the 5m street building line to 0m
Omit the street building line departure (Application 1.3) from the list of applications granted.
Conditions of approval imposed will be renumbered a main heading 3
LAND USE MANAGEMENT
Condition 1 is amended as follows:
1. A revised layout plan with a more appropriate location away from the street boundary (e.g. between the church and the other buildings on the site) be submitted to the Director: Development Management for approval prior to building plan submission.
REASONS FOR DECISION:
1. The proposed 21 m high monopole mast and telecommunications base station installation complies with the principles of the Telecommunication Mast Infrastructure Policy, April 2015, in terms of having no foreseeable adverse impact on the existing environment, the reduced visual impact given the revised height of the mast and the proposal is considered compatible with the immediate / surrounding uses.
2. That no unacceptable negative impact on the surrounding natural and built environment is envisaged provided the cell mast is located away from the street boundary in a more appropriate location.
3. There will be no unacceptable adverse visual impact if the cell mast is located away from the street boundary
4. The rezoning regularizes the existing approved use of the site
