RESOLVED UNANIMOUSLY

That the application for Temporary Departure BE APPROVED on Remainder Erf 308, Brackenfell in terms of Section 98 (c) of the Municipal Planning By-law, 2015 for a period of twelve (12) months subject to the conditions contained in Annexure A.

ADDITIONAL CONDITION:

2.8 That the administrative penalty must be paid within 30 days of the notification of this decision.

Condition 2.1 is amended as follows:

2.1 That the temporary departure shall be valid for a period of twelve (12) months from final notification of this approval

Condition 2.4 is deleted

REASONS FOR DECISION:

1. Access, staking and the provision of parking comply with the standard requirements and were subsequently supported by Transport and Integrated Planning Department.
2. The use is not compatible with the surrounding land uses.
3. Sufficient time has lapsed for the applicant to consider a permanent more suitable location for the business.
4. The proposal would not have a negative impact on the existing services network of the surrounding area as confirmed by the relevant services departments.
5. Deciding the land use application before payment of the administrative penalty is supported to afford the owner the opportunity to relocate the business.
