a. That the application for the subdivision of Erf 421 Constantia, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015, as per plan of subdivision LUM/16/421, subject to the conditions contained in Annexure A.
b. That the application for departures, as set out in Annexure A, for Erf 421 Constantia, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION:
1. The configuration of the access to the subdivided portions is out of character for the area and the built form impact is undesirable.
2. The report was not clear about which is the first and which the second dwelling.
