RESOLVED

a. That the rezoning of Remainder Erf 36555, Milnerton (also referred to as Unregistered Erf 38422, Milnerton) and Erf 2, Richmond Park from various zones (GR1, TR2, OS2, SR1, AG) to General Residential 2 and General Business 1 respectively to permit flats; ‘business premises’ (shops and restaurant) & ‘place of assembly’ (gymnasium, sports field and club-house) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A;

b. That the application for the amendment of condition 2.1 of the approval dated 25 July 2017 (see Annexure D), in order to approve a holistic Site Development Plan for 876 flatlets (includes 180 units constructed) and a ‘business premises’ (i.e. club-house and related uses) in respect of Erven 38435, Milnerton; Remainder Erf 36555 (38422), Milnerton, and Erf 2, Richmond Park, BE APPROVED in accordance with the Site Development Plan attached as Annexure C;

c. That the application for Permanent Departure to relax the on-site parking provision from 1 802 bays (1 752 bays for flats and 50 bays for the club-house) to a total of 1566 bays (1526 bays for flats and 40 bays for the clubhouse) in respect of Erf 38435, Milnerton; Remainder Erf 36555 (38422), Milnerton, and Erf 2, Richmond Park, BE APPROVED, in accordance with the Site Development Plan attached as Annexure C, subject to conditions attached as Annexure A.



CONDITIONS 2.1 and 3.9 ARE AMENDED AS FOLLOWS:

2.1 That a landscaping plan for the development / property must be approved, prior to building plan approval. This landscaping plan shall be for the approval of the Director: Development Management.

3.9 That pro rata development charges be paid by the “Developer” per phase, prior to the approval of building plans in relevant phases.

Conditions 2.3 and 8 are to be deleted


REASONS FOR DECISION:

The MPT APPROVED the application for the reasons set out in the Planner’s report.
