UNANIMOUSLY RESOLVED
a. That the application for consolidation of erven 12130 & 12132, Kuils River BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, subject to conditions as stipulated in attached Annexure A in Addendum A.
b. That the application for rezoning to Subdivisional area in respect of 12130 & 12132, Kuils River BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, in accordance with the Sub-divisional Layout Plan no 2 attached as Annexure C, subject to conditions as stipulated in attached Annexure A in Addendum A.
c. That the application for subdivision in respect of erven 12130 & 12132, Kuils River into 188 portions (184 single residential, 1 open space, 2 utility and 1 transport zone) BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, in accordance with the Sub-divisional Layout Plan no 2 attached as Annexure C, subject to conditions as stipulated in attached Annexure A in Addendum A.
d. That the application for a blanket permanent departure in respect of erven 12130 & 12132, Kuils River, which involves the relaxation of the 3.5 m street building line (applicable to those properties larger than 200 m²) to 1 m and the 3 m common boundary building line to 1.5 m, on all single residential properties BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-law, 2015, in accordance with the Site Layout Plan no 2 attached as Annexure C, subject to conditions as stipulated in attached Annexure A in Addendum A.
ADDITIONAL CONDITION:
That the developer shall be responsible for the submission of civil engineering plans dealing specifically with waste water treatment on the site to the standards and requirements of the Water and Sanitation Department prior to the submission of building plans or prior to subdivision clearances.
REASONS FOR DECISIONS:
The MPT APPROVED the application for the reasons set out in the Planner’s report.
