Resolution details

UNANIMOUSLY RESOLVED that:

a. The application for deletion of a restrictive condition, as set out in Annexure A, for Erf 97656 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.


b. The application for deletion of a condition of an existing approval, as set out in Annexure A, for Erf 97656 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c. The application for departures, as set out in Annexure A, for Erf 97656 Cape Town at Newlands, BE APPROVED in terms of Section 98(b) of the Municipal Planning By- Law, 2015.

d. The application for the subdivision of Erf 97656 Cape Town at Newlands, as per plan of subdivision LUM/00/97656, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 10 as follows:

As indicated in 6.3 of the report, the deletion of the title deed requirements set out in the Municipal Planning By-Law 2015, the Land Use Planning Act 2014 and the Spatial Planning and Land Use Management Act, 2015 were taken into account.
