UNANIMOUSLY RESOLVED that:

The application for rezoning of a portion of Erf 10762 Constantia from Single Residential Zone 1 to Utility Zone, as shown on plan LUM/16/10762, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following amendments:

4. Approval of the proposal will have, on balance, a positive socio-economic impact.

6. The application generally complies with the requirements of the City’s Telecommunication Mast Infrastructure Policy and is not inconsistent with the Southern District Plan and the Cape Town Spatial Development Framework. The proposal supports the Economic Growth Strategy.
7. The approval of this application does not significantly impact on any existing rights and does not lack desirability.

Potential impact will be mitigated by conditions

Amend conditions as follows:
Delete the word ‘poses a health risk to people occupying the buildings’ from condition 2.5.2
